webO3 may need to modify these Terms and Conditions from time to time, in order to keep up with changes in technology, laws and / or regulations. webO3 may choose to provide Customer with prior written notice if the changes significantly affect Customer's services, but webO3 will do so at its sole discretion and is under no obligation to provide such notice. Any change to the Terms and Conditions will be effective within thirty (30) days of their posting on the Website.
1.1. Eligibility Criteria
The services offered on the website are only available to persons with the capacity to enter into a contract, among others, without limiting the generality of the following, our services are only available to persons 18 years of age and over. 2. Creation, Maintenance, Modification and Cancellation of Accounts

The creation of an account is done manually during the first invoice or via a form provided on the website. The fees associated with our services can also be found on our website.
2.2. Validity of Information
You agree to keep your contact information up to date with us and to notify us within a maximum of 10 days when your information changes (moving, change of email address, etc.). You can change your contact information from the Client Area on our Website.
2.3. Account Maintenance and Security
You agree to use your account only for lawful purposes, and you accept full responsibility for the content and data in your account.
You accept full responsibility for maintaining the confidentiality of login data, account number, user name and password (“Account Access Data”). You accept full responsibility for all activity in your account. You agree to notify webO3 immediately of any unauthorized use of your account or any breach of security. You agree that webO3 is not responsible for any loss you may incur as a result of any third party's use of Account Access Data, whether or not you know it. You also agree that you can be held responsible for losses incurred by webO3 or a third party as a result of the use by a third party of your Account Access Data. webO3 encourages you to keep Account Access Data in a safe place and to take precautions to prevent others from accessing and / or using your Account Access Data. You cannot compromise the security of your account or the webO3 infrastructure in any way.
Although webO3 takes several measures to increase the availability and reliability of data stored on its servers, you agree to keep your own backups of all your data stored on webO3's servers, and not to hold webO3 responsible for any loss. , error, or service interruption, whether under webO3 control or not.
2.4. Responsibility for Content
You agree to be solely responsible for the content stored on your hosting accounts. You further accept full responsibility for activity in your account, whether initiated by you, others on your behalf, or by some other means. webO3 disclaims all responsibility for any activity in your account, whether or not permitted by you. 2.5. Suspension and Cancellation of Accounts
Any contracted service is automatically renewed at the end of each payment period. You can cancel the automatic renewal by requesting an official cancellation by email at least 10 days before the expiration date of the service. The cancellation request must include all the details necessary to allow a webO3 agent to correctly identify the account in question.
webO3 may suspend or terminate without prior notice any account that does not comply with these Terms and Conditions in order to maintain a safe and secure environment for all of our customers.
The customer agrees to regularly make backup copies on a local machine of all important data stored on their server. The customer can make a manual backup copy of his account from the server, but agrees not to keep a manual backup copy on the server for more than 7 days, nor to keep more than one backup copy on his account at a time.
webO3 makes courtesy backup copies for most web hosting accounts. However, backup copies cannot be guaranteed and webO3 cannot be held responsible for any lack or deficiency in the backup service. In order to limit the load on the systems, automatic backups can be disabled by webO3 for any account, at its own discretion, and without prior notice.
4. Acceptable Use Policy

5.1. Domain names
webO3 tries to make your life easier by managing some of your domain names and acts as a reseller, these are subject to the terms and conditions of the registrars used and are non-refundable. However, you can request contact, DNS, transfer and other changes from the technical service for free.
5.2. SSL certificates
The use and installation of SSL Certificates offered by webO3 are subject to the terms and conditions of the signatory of the certificate, depending on the type of certificate purchased.
SSL certificates are non-transferable, and non-refundable.
5.3. Assistance Service
The Support Service is a technical consultation service offered by webO3 which is billed by the hour.
webO3 cannot guarantee precise results with its Support Service. While our technicians do their best to complete a particular task on time, the results are entirely dependent on the complexity of the project and the time frame available. If webO3 is unable to complete the task within the permitted time frame, you will be notified and you will have the option of ordering additional hours from the Support Service.
The Support Service is non-refundable once the work is completed and is not covered by our satisfaction guarantee. All costs incurred by the Support Service must be paid in full within thirty (30) days of the work performed.
5.4. Server Monitoring and Update Service
The Monitoring Service is a service offered to quickly detect problems that a server or website may have. The handling of an alert is a technical service offered by webO3 that is billed by the hour.
webO3 configures the alerts issued by the monitoring service to the best of its knowledge and cannot guarantee that in the event of a problem an alert will be issued.
Only security and software updates offered by the operating system are installed unless another service agreement is made. The installation of updates can cause compatibility issues, if such a problem occurs the technical service will do its best to either correct the problem or uninstall the update. Some updates may be omitted for compatibility reasons.
Some updates require a restart of the server and may cause temporary service interruption which is not covered by service guarantees.
5.5. Site Transfers
webO3 cannot guarantee the availability, or the time required to complete an account transfer. We will do our best, but in some cases we may not be able to assist you with transferring data from your old host.
5.6. Indexing in Search Engines
webO3 is not directly associated with any search engine, and is not responsible for the ranking of your website in the search results.
6. Service guarantees
webO3 understands the importance of having a continuously available website, and guarantees server uptime (“uptime”) of 99.9%, calculated monthly. Our servers are considered available if they respond to requests from at least one external verification service.
Any service outage announced or due to scheduled maintenance will not be taken into account when calculating monthly service time. Sporadic or localized outages due to Internet network conditions beyond our control will not be taken into account either when calculating the monthly service time, nor will the Customer's account or DNS manipulation, including programming or configuration errors in Customer's web applications.
If an unforeseen outage causes your website downtime for more than 0.01% of the month (or more than 43 minutes per month), you can request a credit equivalent to 5% of your monthly hosting costs. Credits are only available for hosting accounts, and will apply to future purchases or renewals from webO3 upon receipt of a written request within 10 days of the outage.
Renewal invoices are automatically generated by webO3 at the end of the service and are payable upon receipt unless previously agreed.
All services unpaid after the due date will be suspended immediately, and may be permanently suspended shortly thereafter, at webO3's sole discretion. If you wish to reactivate your services after a suspension, a reactivation fee may apply.
webO3 accepts payment by check, Visa, Mastercard, Paypal, Interac e-mail transfer and bank transfers.
Any failure to pay may result in the interruption of service without notice.
Unless webO3 receives written notice within five (5) business days of sending an invoice or notice, the latter is presumed correct and accepted by the customer.
Any unpaid invoice will be subject to 2% interest, compounded monthly (corresponding to an annual interest rate of 26.86%). Any returned check due to insufficient funds will result in an additional fee of $ 35 plus tax.
9. Refund Policy
The services offered by webO3 are non-refundable. Certain exceptions could arise, so you can request a refund and it will be checked and validated manually.
10. Disclaimer and Limitation of Liability
SUBJECT TO THE WARRANTIES PROVIDED FOR IN THESE TERMS AND CONDITIONS, WEBO3 MAKES NO (i) REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, OF ANY KIND, WITH RESPECT TO THE SERVICES OR PRODUCTS OFFERED OR PROVIDED BY WEBO3, OR DIRECTLY THROUGH A RESELLER, AND THE WEBSITE, ITS CONTENT AND RELATED SERVICES AND (ii) DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF QUALITY MERCHANT, COMPLIANT OR NON-INFRINGEMENT.
WEBO3 SHALL NOT BE, WITH RESPECT TO THE SITE OR ANY OTHER RELATED SITE, IN NO CIRCUMSTANCES LIABLE TO ANY PARTY OR FOR ANY DAMAGE OR DAMAGE ATTRIBUTABLE TO (INCLUDING, WITHOUT LIMITATION) DEFAULT, AN ERROR, OMISSION, OR FOR ANY SPECIAL DAMAGE OR OTHER CONSEQUENTIAL DAMAGE, DIRECT OR INDIRECT, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, INTERRUPTION OF ACTIVITIES, LOSS OF PROGRAMS OR OTHER DATA CONTAINED IN YOUR INFORMATION MANAGEMENT SYSTEM, LOSS OR DAMAGE TO PROPERTY, AND THIRD PARTY CLAIMS, EVEN IF WEBO3 IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Full contract
These Terms and Conditions, along with related policies available at: https://www.webo3.com/en/legal-documents/terms-of-service, as well as the service agreements signed by the parties constitute the complete contract between the parties concerning the subject hereof and replace all proposals, discussions and prior writings between the parties.
In the event of any dispute or discrepancy between these Terms and Conditions, any attachments and / or any service agreement, the service agreement will take first priority and these Terms and Conditions will take second priority in interpreting rights. and obligations of the parties.
12. Force Majeure
webO3 will make every effort to keep its website and services operational. However, certain technical difficulties and other factors beyond its control could, from time to time, cause temporary interruptions of service.
